Seed Data Systems and its affiliates provides this website and the data, information, tools, updates and similar materials delivered or provided by us through the website, collectively the Service, subject to your agreement to and compliance with these Terms and Conditions.
By using the Service, clicking an agree button, or otherwise entering into agreement, you are creating a binding contract with us. If you do not agree to these terms and conditions, you may not use the Service.
We may revise or update this Agreement by posting an amended version through the Service and making you aware of the revisions. Your use of the Service following an update is considered acceptance of the updated Agreement.
Incorporated Terms
The Privacy Policy and other posted product-specific terms are incorporated into this Agreement as if fully set forth herein.
Disclaimer
While we make reasonable efforts to ensure that the Service remains available, we do not represent or warrant that access to the Service will be error-free, uninterrupted, or without defect.
We reserve the right to modify or discontinue, temporarily or permanently, the Service, or any part of it, with or without notice.
The Service may contain typographical errors or inaccuracies and may not be complete or current. We reserve the right to correct errors, inaccuracies, or omissions and to change or update information at any time without prior notice.
Eligibility
You must be at least eighteen (18) years old to use the Service.
By using the Service or making a purchase, you represent that you meet the applicable minimum age requirement.
Rules of Conduct
Your use of the Service is conditioned on your compliance with this Agreement and all applicable laws and regulations. You agree that you will not:
- Modify, adapt, translate, copy, reverse engineer, decompile, or disassemble any portion of the Service.
- Interfere with or disrupt the operation of the Service.
- Transmit viruses, denial-of-service attacks, harmful code, or harmful activity.
- Probe, scan, or test the vulnerability of systems or networks without authorization.
- Impose an unreasonable or disproportionately large load on infrastructure.
- Harvest or collect contact information of other users.
- Scrape or collect content from the Service by automated means.
- Submit false, incomplete, or misleading information.
- Register for more than one user account or impersonate another person or business.
Content Submitted or Made Available to Us
You are under no obligation to submit suggestions, information, ideas, comments, documents, questions, proposals, text, media, software, or other materials to us.
By submitting content or submissions to us, you represent that you have the rights needed to provide them and that doing so does not violate third-party rights.
We are under no obligation to maintain information or materials you submit, post, or make available through the Service. We reserve the right to withhold, remove, or discard such materials at our discretion.
Our Intellectual Property
Our graphics, logos, names, designs, page headers, button icons, scripts, service names, look and feel, layout, color combinations, and software are protected intellectual property.
You acknowledge that the software used to provide the Service and all enhancements, updates, upgrades, corrections, and modifications are protected by copyrights, patents, trade secrets, trademarks, or other proprietary rights.
Data Collection and Use
You understand and agree that our Privacy Policy governs the collection and use of data obtained through your use of the Service.
Enforcement and Termination
We reserve the right to deny all or part of the Service to any user, in our sole discretion, at any time.
All grants of rights from you to us related to content, submissions, or other materials survive termination or expiration of this Agreement.
Links and Third-Party Content
The Service may contain links provided for informational purposes only. We do not endorse any website or service through the provision of such links.
The Service may contain materials originating from third parties. We do not endorse third-party content that appears on or is accessed through the Service.
Disclaimers and Limitation on Liability
Except where not permitted by law, the Service is provided as-is and as-available, without any warranty or condition, express, implied, or statutory.
Use of the Service is at your sole risk. We do not warrant that you will be able to access or use the Service at all times, that the Service will be uninterrupted or error-free, or that defects will be corrected.
To the maximum extent permitted by law, Seed Data Systems and related parties will not be liable for indirect, special, incidental, punitive, exemplary, or consequential damages related to the Service.
Indemnification
You agree to defend, indemnify, and hold us and our suppliers, subsidiaries, licensors, licensees, officers, directors, shareholders, members, employees, and agents harmless from claims, losses, liabilities, damages, fees, and expenses arising from your use of the Service or violation of these terms.
Governing Law and Jurisdiction
Any claim or dispute arising out of or relating to the Services will be resolved under applicable Indian law and arbitration rules, unless otherwise required by law.
Arbitration under this Agreement will be located in Ahmedabad, India. To the extent arbitration does not apply, disputes may only be brought in courts located in Ahmedabad, Gujarat, India.
General
If any provision of this Agreement is found unlawful, void, or unenforceable, that provision will be given maximum enforceable effect or deemed severable, and the remaining provisions will remain in full force.
Copyright Policy
If you believe in good faith that material posted on our Service infringes the copyright in your work, contact contact@seeddatasystems.com with:
- A physical or electronic signature of the owner or authorized person.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing and information sufficient to locate it.
- Information sufficient to permit us to contact you.
- A statement that you have a good faith belief that use of the material is not authorized.
- A statement that the information in the notification is accurate and that you are authorized to act on behalf of the owner.
Complaint Policy
If you believe in good faith that material posted on the Service infringes rights other than copyright, or is otherwise unlawful, send a notice to contact@seeddatasystems.com containing:
- Your name, physical address, email address, and phone number.
- A description of the material that you believe violates your rights or is otherwise unlawful.
- Identification of the location of the material on the website or apps.
- A statement describing the basis of the rights or laws you believe are violated.
- A statement under penalty of perjury that your notice is accurate and made in good faith.
- Your physical or electronic signature.
Refund Policy
Seed Data Systems accommodates clients as much as possible and considers cancellations case by case. As a service provider, our offering is not a tangible product that can be returned.
Projects are undertaken under agreed contracts and milestones. Refunds are generally not possible for work already completed, services already procured, or services already consumed.
- Seed Data Systems undertakes projects under agreed contracts and milestones that define workflow and roadmap.
- Web, mobile, design, development, and application work is accepted after scope analysis to reduce misunderstanding and rework.
- In mutual project termination, the client may control work completed to that date, subject to full payment through that date.
- If a client chooses a different provider within 48 hours of project initiation, Seed Data Systems may refund 50% of advance project fees.
- No cancellations are entertained for limited-period offers or special occasion services.
- Development services and consulting under Time and Material or Hire Dedicated Developer models are non-refundable.
Cancellation Policy
Cancellation requests must be submitted by email to the Project Management Team at contact@seeddatasystems.com or the official email provided at contract signing. Requests are considered only when received through the approved channel.
- We take a minimum of two weeks to process a cancellation request. Service fees apply until the request is processed.
- Project cancellation is based on the service level agreement agreed with the client at project start.
